Looking beyond the crash report
A police report records the collision, statements, citations, and visible damage, but it doesn't always explain why a driver failed to brake, drifted from a lane, or never reacted to stopped traffic. Distraction can be difficult for law enforcement to identify during an initial crash investigation, and distracted-driving incidents may be underreported.
You're not expected to arrive at the first conversation with phone records or a finished case file.
Depending on the wreck, we may look for:

Photographs of the vehicles, road, traffic controls, and surrounding area

Dashcam, traffic camera, doorbell, or nearby business video

Witness accounts and statements made at the scene

911 calls, dispatch recordings, and available law-enforcement records

Vehicle information and event-data-recorder information, when relevant

Phone-related records that may lawfully be obtained through the proper legal process
Vehicle event data can sometimes show pre-crash dynamics — speed, braking, accelerator use — depending on the vehicle and the crash. Some evidence can be overwritten, misplaced, or harder to locate the longer you wait. That's why an early review matters, even before anyone knows whether a phone was involved.
Possible warning signs: no braking before impact, lane drifting, delayed reactions, failure to notice stopped traffic, looking down, a visible phone, witness observations, or inconsistent statements.
Georgia's Hands-Free law
Georgia law prohibits drivers from physically holding or supporting a wireless device while driving. It also prohibits writing, sending, or reading text-based communications, and restricts watching, recording, or broadcasting video while driving. A driver doesn't have to be texting to be distracted — navigation systems, food, reaching for an object, passengers, and entertainment controls can also take attention off the road.

Yes. Georgia's Hands-Free Act, effective July 1, 2018, prohibits holding or supporting a phone while driving, along with writing, sending, or reading text-based communications behind the wheel.
Yes. A Hands-Free Act violation can be used as evidence of negligence in a civil claim. That's one reason an early review matters; the sooner we're involved, the more evidence we can identify and help preserve.
It's not always obvious from the police report alone. We look at photos, video, witness statements, 911 recordings, vehicle event data, and, when legally obtainable, phone records, to build a fuller picture of what happened in the moments before the crash.
