LOOKING BEYOND THE CRASH REPORT

Was the other driver looking at a phone or simply not looking at the road?

Distracted drivers do not always admit what they were doing. A police report may record the collision, statements, citations, and visible damage without explaining why a driver failed to brake, drifted from a lane, or never reacted to stopped traffic.

You are not expected to arrive at the first conversation with phone records or a finished case file. Distraction can be difficult for law enforcement to identify during an initial crash investigation, and distracted-driving incidents may be underreported.

Depending on the wreck, we may look for:

  • Photographs of the vehicles, road, traffic controls, and surrounding area

  • Dashcam, traffic camera, doorbell, or nearby business video

  • Witness accounts and statements made at the scene

  • 911 calls, dispatch recordings, and available law-enforcement records

  • Vehicle information and event-data-recorder information, when relevant

  • Phone-related records that may lawfully be obtained through the proper legal process

Vehicle event data can sometimes show pre-crash dynamics and driver inputs such as speed, braking, or accelerator use. The information available depends on the vehicle and the crash. Some evidence may be overwritten, misplaced, or become more difficult to locate. Memories also change. That is why an early review can matter even when no one yet knows whether a phone was involved.

Georgia Hands-free Law

Georgia law prohibits drivers from physically holding or supporting a wireless telecommunications device while operating a vehicle. It also prohibits writing, sending, or reading text-based communications and restricts watching, recording, or broadcasting video while driving.

A driver does not have to be texting to be distracted. Navigation systems, food, reaching for an object, passengers, entertainment controls, and other activities can also take attention away from the road.

Hugh Morris is a Leesburg native who has practiced law in Georgia since 1999. Before becoming a lawyer, he earned a degree in risk management and insurance from the University of Georgia and worked in insurance.
